A la ONU una querella por la muerte de Ojeda Ríos

El capítulo de Puerto Rico de la Asociación 
Americana de Juristas presentará en junio ante la 
Organización de las Naciones Unidas (ONU) una 
querella contra el Gobierno de Estados Unidos por 
lo que entienden fue la ejecución del líder 
machetero Filiberto Ojeda Ríos por parte de 
agentes del Negociado Federal de Investigaciones.

La organización, a través de los abogados Fermín 
Arraiza y Ricardo Alfonso, también acudirá entre 
el 2 y el 6 de junio ante el Consejo de Derechos 
Humanos de la ONU para denunciar ese mismo hecho 
y recabar apoyo de otras organizaciones no gubernamentales para la querella.

“Iremos allí a denunciar el asesinato de 
Filiberto Ojeda y el encubrimiento de las 
autoridades gubernamentales”, dijo Hiram Lozada, 
presidente del capítulo de Puerto Rico de la Asociación Americana de Juristas.

El investigador de la ONU ante el cual se 
someterá la querella, a finales de junio, sería 
Philip Alston, relator de Ejecuciones Arbitrarias, Extrajudiciales o Sumarias.

Urgen pesquisa profunda

“Incluiremos en la denuncia la negativa del 
gobierno federal de dar todo tipo de información 
relevante para poder llevar a cabo una 
investigación imparcial y profunda”, indicó Arraiza.

El Departamento de Justicia de Puerto Rico acudió 
sin éxito hasta el Tribunal Supremo de Estados 
Unidos buscando que se obligara al gobierno 
estadounidense a ofrecer la información que 
tuviera en su poder sobre la muerte de Ojeda Ríos 
a manos de un agente del FBI en un operativo para 
arrestarlo en el 2005 en Hormigueros.

Arraiza abundó que el investigador puede recibir 
una querella sobre el caso de Ojeda Ríos incluso 
si en la Isla no se han terminado las pesquisas 
en curso y sin que se hayan agotado todos los recursos del gobierno local.

Una vez que el relator reciba la querella, se le 
notificaría al gobierno de Estados Unidos sobre 
su existencia y el Departamento de Estado federal 
debería hacer una invitación formal a Alston para 
que viaje a Puerto Rico a realizar su investigación.

The Puerto Rico chapter of the American 
Association of Jurists will present to the United 
Nations (U.N.) in June a complaint against the 
Government of the United States for what they 
understand to be the execution of Machetero 
leader Filiberto Ojeda Ríos by agents of the Federal Bureau of Investigations.

The organization, through attorneys Fermín 
Arraiza and Ricardo Alfonso, will also appear 
between June 2 and 6 before the U.N. Human Rights 
Council to denounce this act and obtain support 
from other non-governmental organizations for the complaint.

“We will go there to denounce the assassination 
of Filiberto Ojeda and the coverup by 
governmental authorities,” said Hiram Lozada, 
president of the Puerto Rico chapter of the American Association of Jurists.

The U.N. investigator before whom the complaint 
will be submitted at the end of June will be 
Philip Alston, Special Rapporteur on 
Extrajudicial, Summary or Arbitrary Executions.

To press for profound investigation

“We will include in the denunciation the federal 
government’s refusal to give any type of relevant 
information so that an impartial and profound 
investigation could be conducted,” Arraiza stated.

The Puerto Rico Department of Justice resorted, 
with no success, all the way to the United States 
Supreme Court, seeking to oblige the U.S. 
government to offer the information under its 
control about the death of Ojeda Ríos at the 
hands of an FBI agent in an operation to arrest him in 2005 in Hormigueros.

Arraiza elaborated that the investigator may 
receive a complaint about the Ojeda Ríos case, 
even though the investigations under way in the 
Island have not terminated and even though all 
local government remedies have not been exhausted.

Once the rapporteur receives the complaint, he 
will notify the United States government, and the 
U.S. Department of State must extend to Alston a 
formal invitation to travel to Puerto Rico to carry out his investigation.
