CDC citará a federales por caso de Ojeda Ríos
Propone que comparezcan a las vistas que evalúan

La Comisión de Derechos Civiles (CDC) se propone 
citar a funcionarios federales a comparecer a las 
vistas que evalúan la posible violación de 
derechos durante el operativo en el que murió el 
líder de Los Macheteros, Filiberto Ojeda Ríos.

"Para la segunda fase de vistas públicas, 
citaremos diversos testigos entre los que se 
encuentran: fiscales del Departamento de 
Justicia, ciudadanos particulares, patólogos y 
personal del Instituto de Ciencias Forenses, 
oficiales de la policía de Puerto Rico y de otras 
agencias de gobierno, así como empleados 
federales"', dijo José Irizarry Yordán, presidente de la comisión.

El director ejecutivo de la CDC, Lorenzo 
Villalba, explicó que entre los funcionarios 
citados estarían Rosa Emilia Rodríguez y Humbert 
S. García, jefa y ex jefe de la fiscalía federal, 
respectivamente, y Luis Fraticelli, director en 
Puerto Rico del Negociado Federal de 
Investigaciones (FBI), además de otros 
funcionarios federales cuyos nombres surjan de 
las vistas públicas o documentos.

"Tenemos que seguir el procedimiento y la 
reglamentación federal, aunque digan que no, 
nosotros vamos a seguir ese procedimiento", afirmó Villalba.

¿No es un ejercicio fútil?, se le preguntó. 
Aunque la CDC tiene autoridad del gobierno 
estatal de citar so pena de desacato, han sido 
infructuosas las gestiones iniciales del gobierno 
isleño -como demandas judiciales- para obtener información de los federales.

"Queremos dejar claro nuestros requerimientos y 
nuestro poder. Yo no lo llamaría fútil... uno 
nunca sabe qué va a pasar en noviembre de 2008 en 
Estados Unidos con un cambio de administración y 
quizá vienen con el ánimo de revisar qué ocurrió allí", dijo Villalba.

Harry Rodríguez, portavoz del FBI, dijo que la 
agencia no ha recibido citación alguna, pero que 
en el momento en que la reciban será evaluada.

Ojeda Ríos murió de un disparo de un 
francotirador del FBI el 23 de septiembre de 2005 durante un operativo.
La CDC actualmente evalúa documentos recibidos de 
manos del Departamento de Justicia de Puerto 
Rico, incluyendo 2,000 fotografías, 81 
declaraciones juradas y sobre 50 informes 
periciales, que incluyen informes de autopsia, 
análisis balístico, reconstrucción de escena, así 
como análisis del patrón de manchas de sangre.

Además, la CDC ya cuenta con 680 páginas de la 
transcripción de los primeros días de vistas 
públicas, celebradas en mayo, en la que 
comparecieron funcionarios como el 
superintendente Pedro Toledo y el ex director de 
Ciencias Forenses, Pío Rechany.

No hay fecha para la continuación de las vistas 
en lo que se evalúan estos documentos, pero en 
las próximas dos semanas la CDC realizará una 
visita informal a la casa de Ojeda Ríos en Plan Bonito, Hormigueros.

De otra parte, la senadora María de Lourdes 
Santiago pidió a la CDC que se cite al abogado 
José Carreras que expresó al Diario La Prensa de 
Nueva York que oyó la última ráfaga de tiros en 
Plan Bonito pasadas las 7:00 de la noche, cerca 
de una hora más tarde que la información oficial suministrada por el FBI.

The Civil Rights Commission (CRC) proposes to 
subpoena federal functionaries to appear at the 
hearings that are evaluating the possible rights 
violations during the operation in which the 
leader of The Macheteros, Filiberto Ojeda Ríos, died.

"For the second phase of public hearings, we will 
subpoena various witnesses including: Department 
of Justice prosecutors, particular citizens, 
pathologists and personnel of the Institute of 
Forensic Sciences, officials of the Puerto Rico 
police and other government agencies, as well as 
federal employees," said José Irizarry Yordán, chair of the commission.

The executive director of the CRC, Lorenzo 
Villalba, explained that among the subpoenaed 
functionaries will be Rosa Emilia Rodríguez and 
Humbert S. García, chief and former chief of the 
U.S. Attorney’s office, respectively, and Luis 
Fraticelli, director of the Federal Bureau of 
Investigations in Puerto Rico, in addition to 
other federal functionaries whose names have 
emerged at the public hearings or in documents.

"We must follow the procedures and federal 
regulations, even if they say no, we are going to 
continue these proceedings," affirmed Villalba.

One might ask, "isn’t it an exercise in 
futility?" Even though the CRC has the authority 
of the state government to subpoena under penalty 
of contempt, the initial efforts of the island 
government, such as lawsuits, have not been 
fruitful in obtaining information from the federal authorities.

"We want to be clear about our requirements and 
our power. I wouldn’t call it futile... one never 
knows what will happen in November of 2008 in the 
United States with a change of administration, 
and maybe it will come with the intention of 
reviewing what happened here," said Villalba.

Harry Rodríguez, FBI spokesperson, said that the 
agency has not received any subpoenas, but that 
when they are received they will be evaluated.

Ojeda Ríos died from an FBI sharpshooter’s bullet 
on September 23, 2005 during an operation.

The CRC is currently evaluating documents 
received from the Puerto Rico Department of 
Justice, including 2,000 photographs, 81 sworn 
statements and over 50 expert reports which 
include autopsy reports, ballistic analysis, 
reconstruction of the scene, as well as analysis of the blood stain patterns.

In addition, the CRC already has 680 pages of 
transcripts of the first days of the public 
hearings, which took place in May, at which 
functionaries such as superintendent Pedro Toledo 
and the former director of Forensic Sciences, Pío Rechany, appeared.

There is no date set for the continuation of the 
hearings, while the documents are evaluated, but 
in the next two weeks the CRC will hold an 
informal hearing at Ojeda Ríos’ house in Plan Bonito, Hormigueros.
On the other hand, senator María de Lourdes 
Santiago asked the CRC to subpoena attorney José 
Carreras, who told El Diario La Prensa of New 
York that he heard the last round of shots in 
Plan Bonito after 7:00 at night, about an hour 
after the official information submitted by the FBI.
