Briana Waters detained until May 30 sentencing

A federal magistrate judge has ruled that a woman 
recently convicted in the Earth Liberation 
Front's 2001 arson of the University of 
Washington Center for Urban Horticulture will 
remain jailed until her sentencing May 30.

Briana Waters, 32, of Oakland, Calif., had a 
detention hearing Wednesday. She has been in 
federal custody since a jury convicted her of 
arson last week. Her lawyers asked the judge to 
release her until her sentencing so she would 
have more time to spend with her partner and their 3-year-old daughter.

The U.S. attorney's office opposed the request, 
saying that the law requires people convicted of 
violent crimes to be detained pending sentencing. 
Waters does not deserve an exception, prosecutors said.

They also said several other people involved with 
the Earth Liberation Front in the Pacific 
Northwest ­ including Waters' former boyfriend, 
Justin Solondz ­ have fled the country to avoid 
prosecution, and they argued for the first time 
that Waters was involved in more than one arson.

Not only did she serve as a lookout during the 
horticulture center arson in May 2001, they wrote 
in a court filing, but she also participated in 
an attack at the Litchfield Wild Horse and Burro 
Ranch in Susanville, Calif., later that year. 
They cited a statement from Stanislas Meyerhoff, 
who was convicted in that fire and is serving a 13-year federal sentence.

Waters maintains her innocence.
